Firmigoni: after 5 years the Council of State certifies the illegality of 2010 Regional Elections


Five years after we presented the appeal - one month ahead of the 2010 Regional Elections in Lombardy - by which we asked for the exclusion of Roberto Formigoni and his coalition from the electoral race, administrative proceedings have concluded. The Council of State, overturning the judgement with which the Lombardy Regional Court has readmitted Formigoni to the elections, has established as follows:

"It results that - and this has not been disputed by the counterparties - if the 723 signatures declared false by the civil judge would have been subtracted from the 3.918 signatures collected, the electoral list "For Lombardy" would not have reached the minimum number of subscription (3.500 signatures) requred by Law for the presentation of electoral lists; hence the admission of the list in question to the electoral race was erroneous and thus the subsequent elections, which culminated in the proclamation of the elected to the Regional Council and of Mr. Roberto Formigoni as President of the Regional Council, were invalid."

The Council of State "declare the proclamation of the elected and the elections for the renewal of the Lombardy Regional Council held on March 28 and 29, 2010, illegal" and "rules in favour of Mr Marco Cappato and Mr Lorenzo Lipparini for the expenses and fees in both sets of proceedings for a total amount of 20.000€".

The five-year delay since our appeal is emblematic for how democracy is completely erased and denied. We ask the President of the Republic and the Presidents of the Parliamentary Chambers to intervene in order to prevent the repetition of a similar attack on the civil and political rights of citizens.
