WARNING! THERE CANNOT BE “ELECTIONS” WITHOUT DEMOCRACY, BUT ONLY VIOLENT FICTIONS AGAINST HUMAN AND CIVIL RIGHTS
If –as is unfortunately now most probable– the regional elections of 27-28 March 2010 are carried out under the present conditions, those of the negation of the rule of law and democracy, the decision to participate or not will inevitably become a dire conflict of conscience (for non-violent democrats as we are) faced with a certain risk of incurring the crime of complicity with the machinations of a Regime that radically denies human, constitutional, international, individual and collective rights; a Regime that continually and progressively manages to reduce the State to a mere legalistic cover of such crimes.
IS ITALY FALLING TOWARDS PUTINIAN/CAUCASIAN ELECTIONS?
We must establish that since the European “elections” of June 2009, there has been a continually increasing involvement of all the Institutions of the State be they political, administrative or supervisory, causing them to fall, by sheer gravitational force, into a bottomless pit of behaviors marked –by acts or omissions– by anti-democratic lawlessness and aggressions. As for the institutional developments –contrasting those of the European elections– we refer to the already mentioned documentation made public (and suddenly become clandestine!) and the situation’s most grievous and ongoing acceleration during recent days.
AN UNPRECEDENTED MASSACRE OF LEGALITY IS UNDERWAY IN ITALY
Accelerations or, more specifically, manipulations of outcomes of legitimate organs such as that of the grotesque, scandalous and desolating position of the Indipendent Authority on Communications, AGCOM, and that of the parliamentary Oversight Committee of Public TV and Radio, Rai, in a span of less than 48 hours. AGCOM, after 10 years of deliberate criticisms against Rai (with about 50 sentences), suddenly has turned its own jurisprudence upside down, while the Oversight Committee attempts to annul recent deliberations, those of the proposals of Rapporteur Marco Beltrandi, MP. 48 hours after a new code of conduct had been adopted by the Committee, Berlusconi's rightist party expressed its regret and overturned the deliberations by the Parliamentaru body returning to the fold and common manger of their l"arch-enemies", the so-called “Kommunists”.
THE FORBIDDEN ELECTIONS
These decisions had, and have, as their principal objective the ensure, at least in the last four weeks before the vote, for a majority of voters the ability to directly compare competing parties, in addition to the presence and participation of the leaders of the competing forces in other TV programs; a concept common to all countries with effective democratic institutions.
It is necessary to resuscitate those public political, and electoral fora, formally abolished despite the specific laws and rules that foresee them; after already having reduced them to two semi-clandestine broadcasts over the last seven months, outclassed by games for the numb plebes at the Coliseum of prime time shoes for hundreds of millions of viewers - in fact almost half a billion.
EUROPEAN ELECTIONS, AFTER THE MORAL PERSUASION OF THE PRESIDENT OF THE REPUBLIC: IN ITALY 65% OF THE ELECTORATE VOTES, COMPARED TO THE 43% AVEGAGE OF THE REST OF EUROPE. THE CONTRIBUTION OF THE RADICAL’S RESISTENCE
When, in May 2009, the Radical Movement and its umbrella of organizations documented that only 3% of voters were informed about which political forces were officially taking part in the European elections, an immediate act of “moral persuasion” was put in place at the highest institutional level, making a significant positive adjustment to the degree of failure to involve civil and democratic forces. Those forces unwelcome because foreign to the power of the partitocratic one-party regime. One result of all this was resounding, albeit censored, silenced: this is the Italy that turned out to be among the first of the 27 EU countries in terms of voter participation (after Belgium, Holland and Malta), over 65% voters, against a European average of 43%.
The moral suasion of the President of the Republic, provoked and permitted by the denouncements and actions of the List Emma Bonino-Marco Pannella, with this unprecedented result, has fully legitimized and validated our final decision to participate in those European "elections".
FINALLY THE LEADER OF THE DEMOCRATIC PARTY, BERSANI ARRIVES, TOO LATE TO REDRESS THE DAMAGE DONE BY HIS PREDECESSOR VELTRONI
The second objective of the strategic agreement between the major opposition party, Democratic Party, PD, and the ruling People of Freedom, PDL, was not missed: the aggreement concluded - and then defended - by both sides, by Berlusconi on the one hand and by Veltroni and his vice Franceschini on the other: the elimination of all extraneous and non-conformant political forces not privy to this infamous pact that held for the national elections of 2008, the European elections of 2009, and the current Regional elections of 2010.
In particular, they both sought, and obtained, the very painful elimination of the Radicals from the European Parliament, after 30 years of uninterrupted, and often prestigious, European and international presence. Unfortunately new PD Bersani has finally come, but too late, to repair the disastrous previous political results.

From 1 September to 20 October the Radicals were non-existent in the principal editions of Tg1 . Even considering the preceding period (from 8 June, 5 months) the interviews total 6 for 2'8'' equal to 0.43% of the time dedicated to all politicians.
Even considering the previous period (from 8 June, 5 months) there are a total of 6 interviews, equivalent to 2 minutes and 8 seconds, which is 0.43% of the time of all politicians.
In the period September 1 to October 20, Tg2 dedicated to radical 44 seconds in 2 appearances, equal to 0.36% of political presence.
As for the Tg1, taking into account the post-election period, the appearances are 6 over 5 months for a total of 1 minute and 53 seconds, equal to 0.5% of the total.
Tg3 , in the last 2 months, has dedicated 2 voice appearances for a total of 1 minute and 22 seconds, or 0.66%, while in post-election period, there are a total of 12 appearances, for 4 and 47 seconds, equal to 1,06% of the total.
No presence at TG4 the last 2 months, and only one presence for 14 seconds gong back to the last 5 months.
The TG5 has given to the radical 33 seconds in two appearances from September to October 20, and the 10 attendence from 8 June to 20 October for 3 minutes and 34 seconds, equal to 1,07% of the total.
On Studio Aperto , the only appearance in 5 months is for 4 seconds.
The Radicals were also absent from the Tg of La7the last 2 months, whereas the only attendence in 5 months was of 34 seconds.
In total the Tg of the major Rai networks have devoted to the radicals 2 minutes and 6 seconds, in 4 voice appearances from September 1 to October 20. During the same period Tg Mediaset have dedicated 37 seconds in 3 appearances
From 8 June to 20 October: on Tg1: Bonino at 54th place (1'12'') - Pannella at 96th place (22''); On Tg2: Bonino at 67th place (44'') - Pannella at 72nd (35''); On Tg3: Bonino at 39th place (2'28'') - Pannella at 59th place (1'18'').
Note: The average number of daily number of listeners for Radio-Rai totals approximately 12 million, compared to a daily average of 5,300,000 viewers for TV Rai. That is twice the number of radio listeners than TV viewers. It would be useless – we believe – to comment on this, but I think that, soon, when we provide the facts, all will truly realize the type of “atomic” bomb that radio actually is compared to TV! And what kind of treatment, obviously, awaits those listeners that would like to simply know a little “something” about us. You are still convinced that it is excessive to talk about a sixty year regime far worse and more devastating than the twenty year patritocratic regime of fascism.
Dossier on the Destructive Contribution by the Italian United Partyist Institutions
In the seven months following the vote for the new European Parliament of June 2009, the denial of democracy and the rule of law in Italy has worsened, so as to render it once again inappropriate to speak of elections in our country in terms of democracy.
This document lists the violations of law and the sabotage that have characterized this first stage of the electoral process relating to the 28-29 March 2010 regional elections, grouped according to three issues:
1. .The manipulation of electoral laws
2. The abolition of all rules and information on elections and on the collection of signatures for the presentation of electoral lists
3. The abolition of civil rights by force in the pre-election stage of presentation of lists
I) The Manipulation of Electoral Laws in the Current Year
As already happened in the general elections of 2006 (Law No. 270 of December 21, 2005, vote on 9 and 10 April 2006) and the European elections of 2009 (Law No. 10 of 20 February 2009, vote on 6 and 7 June 2009), the regional elections of March 2010 will be characterized as well by the change of electoral laws while the campaign is already under way and at less than six months from the vote, which is the time limit specified by the Council of Europe not to consider a change in electoral law as a tool for the incumbent to manipulate the system in their favour, at the expense of popular sovereignty.
In view of the regional elections in 2010, six electoral laws were changed less than a year before the elections:
· Calabria: Regional Law No. 4 of 6 February 2010
· Basilicata: Regional Law No. 3 of 19 January 2010, amended again on 4 February 2010
· Umbria: Regional Law No. 2 of 4 January 2010
· Tuscany: Regional Law No. 50 of 5 August 2009
· Piedmont: Regional Law No. 21 of 29 July 2009
· Campania: Regional Law No. 4 of 27 March 2009
II) The Abolition of all Rules and Information on Elections and on the Collection of Signatures for the Presentation of Electoral Lists
In many areas, less than a month after the deadline for the presentation of the electoral lists for the upcoming regional elections, it was impossible to collect signatures to present lists of candidates due to a grave uncertainty about the applicable rules.
National law -like most of the regional regulations- mandates that 180 days before the vote, the collection of signatures to present the lists of candidates must be allowed to begin on forms approved by the Ministry of the Interior or prepared by the regions that have adopted their own election laws.
This has been the case in the following regions:
· Calabria: the electoral law of 6 February 2010 changed the minimum and maximum number of candidates to be included in the provincial lists, making all the signatures collected up to then unusable.
· Campania: only since 1 February 2010 has it been possible to have the official form for the acceptance of application and the submission of lists
· Umbria: Due to the electoral law adopted on 4 January 2010, until the end of the month it has not been possible to collect signatures for the lack of specific directions concerning the procedure for collecting signatures
· Basilicata: Due to the electoral law adopted on 14 January 2010 and again amended for clearly being unconstitutional, until early February it has not been possible to collect signatures for the lack of information concerning the minimum and maximum number of candidates to be included in the provincial lists and the procedure for collecting signatures
· Marche: The regional electoral law prohibits the collection of signatures until the beginning of the election campaign, which is only 30 days before the expiration of the deadline for submitting candidates.
· Puglia: until the end of January there was no certainty about the forms for collecting signatures
III) The Abolition of Civil Rights by Force in the Pre-Election Stage of Presentation of Lists
Even the mere attempt to run for election was in fact sabotaged thus far.
The burden of collecting signatures, created to defend democracy and curb frivolous campaigns and the lists that do not have representation, has become instead a tool to prevent access to the elections of those political forces who live outside the partyist system.
In the face of 160 thousand signatures, authenticated and certified, the complexity required to submit lists of candidates in regional elections has made it virtually impossible to legally collect signatures for a political force that does not already have municipal and provincial councilors [who, by law, are among those authorised to certify and authenticate signatures. ndt].
Indeed, despite the provisions of art. 4 of Law No 43/95 :
· Italian citizens were not in any way aware of how within the electoral process to excercise their right to sign to the list of candidates
· 200 thousand people, to whom the law gives the function to authenticate the signatures have not received any instructions on how to effectively exercise their power and duty to do so •Municipalities, provinces, courts and prosecutors have not prepared and organized a public service for authentication, which the law foresees to take place also outside the municipal offices
· 75% of municipalities are not equipped with the PEC (certified electronic mail), which has been compulsory since 30 June 2009, and this has prevented the Lista Bonino-Pannella to send, low-cost and on time, forms of provincial lists to citizens for their signature (subsequently sent at high cost, by courier, to 3400 municipalities)
· Even today most municipalities do not comply with legal requirements in terms of opening hours of offices, ease of signature for citizens who wish to sign for a list, presence of public notices visible also when the offices are closed
· The public broadcasting service RAI, also violating the provisions of the Regulations approved by the Parliamentary Committee of Oversight of public TV, does not ensure information about election procedures and how to subscribe to the list of candidates
The Bonino-Pannella List has solicited the interest of the competent institutions in all possible ways:
· 26 January: Letter to the Minister of the Interior Maroni and Minister of Justice Alfano, which called for action to ensure the regularity of the process of collecting signatures, informing citizens through RAI and ensuring the public service authentication, which was denounced as absent.
· 26 January: Letter to the President of the ANCI, National Association of Municipalities, and UPI, National Union of Provinces, to ask that they ensure that municipalities make available the authenticators of signatures
· 7 February: legal notice to RAI, its Board and Director General and the editors of national news and regional authorities, requiring that citizens be informed of the electoral process and their right to sign the lists, indicating the opening hours of the municipal secretariats.
To date, nothing seems to have been done to address a situation which is now approaching utter disrepair
