VATICAN : ON THE INITIATIVE OF MAURIZIO TURCO (RADICALI) 53 MEPS DENOUNCE THE INTERFERENCES OF THE HOLY SEE IN THE LAWS ON MARRIAGE AND DIVORCE


Brussels, 21 February 2002 - Declaration of Maurizio Turco, President of the Radical MEPs:

"Today I have tabled a motion for a resolution signed by 53 deputies, denouncing the interferences of the Holy See in the laws on marriage and divorce.

The resolution is a reaction to the speech made by the Supreme Pontiff on 28 January 2002, on the occasion of the inauguration of the judicial year of the the Vatican City State. In his speech the "Sovereign of the Vatican City State" called for a modification of civil and democratic legal systems to introduce the indissolubility of marriage, opposition to the introduction of measures in favour of divorce or measures that give de facto unions, especially homosexual unions, the same status as matrimony, as well as the promotion of "true matrimony"; and called on persons who work in the field of civil law, such as magistrates and lawyers, to refuse to co-operate with divorce proceedings, because they are "contrary to justice".

Reasserting that the principle of laity, i.e. the separation between Church and State, constitutes a fundamental principle that has led to the recognition of fundamental rights and liberties - such as the right to divorce - and implies the full independence of public institutions and of their field of competence from clerical or confessional influences and organisations, the signatories of the resolution denounce the statements of the Supreme Pontiff as undue interference with the aim of subverting the principle of the impartiality of civil law and to make the respect of specific religious prescriptions prevail over the respect of acquired civil rights."
